FORT SMITH - Several months after a lawsuit was filed against the city regarding a new right-of-way ordinance governing public roads, the Fort Smith City Board will consider repealing it at a work session scheduled for Tuesday.

Ordinance 34-17 was passed to prohibit people from occupying roadway portions of the public rights of way, and also established a special permit for the use of landed roadways.

The lawsuit was filed in September by Glynn Dilbeck, who has filed a previous legal action against Arkansas cities regarding the right to panhandle.

The Board of Directors will also study the possibilities of annexing unincorporated areas within the city of Fort Smith.

The meeting begins at 12:00 PM, in the community room of the Fort Smith Public Library.
