Walter Kinsey agreed to a plea agreement moments before his trial was to begin Thursday to the rape of a juvenile and will serve 10 years in prison.
Crawford County prosecutor Marc McCune said the plea deal was not based on whether or not Kinsey was guilty of the rape of a juvenile less than 14 years old.
The 78-year-old Alma man was accused of rape in an incident that occurred Sept. 1 last year.
The victim’s family agreed to the offer with the condition that the child take the stand and tell what Walter Kinsey did to her.

In addition to the prison time and suspended sentence, it included restitution for the victim for counseling and whatever other treatment she may need.
Kinsey will have to serve a minimum of seven years before he is eligible for parole and must complete the sexual offender program while in prison. He had an additional 15 years suspended.
“It was, based on the facts, a question of whether or not he was guilty of sexual assault second degree or rape,” said McCune.
